2. Relationship to Service Agreement

If you are a client who has signed a Web Presence Service Agreement with us, the terms of that specific written agreement shall take precedence over these general Terms of Service.

Conflict Resolution: In the event of any conflict between these website Terms of Service and your signed Service Agreement (including specific subscription tiers, fees, and contract duration), the provisions of your signed Service Agreement shall control.

3. Description of Services

We provide "Web Presence as a Service," which may include managed hosting, website design, and AI-driven growth tools.

• Specifics: Detailed deliverables, such as the distinction between "Essentials" and "Premier" tiers, are outlined in your individual Service Agreement.
• Third-Party Integrations: Our services often integrate with third-party platforms (e.g., Google Maps, Calendly, Facebook). We are not responsible for changes to these platforms' APIs or pricing models.

4. Artificial Intelligence (AI) Disclaimer

Our website and services utilize Artificial Intelligence for features such as the AI Web Assistant and Social Autopilot.

• Accuracy: You acknowledge that AI is an automated tool and may occasionally generate incorrect or factually inaccurate responses ("Hallucinations").
• Liability: We are not liable for errors, hallucinations, or offensive statements generated by AI tools. Clients using these tools are responsible for monitoring their output.

5. Intellectual Property

• Our Content: The source code, design, and content of this website are owned by us.
• Client Ownership: If you are a client, you retain full ownership of your business name, logos, and specific images provided to us, as outlined in Section 7 of your Service Agreement.
• Site Code: Ownership of developed website source code remains with the Developer until the completion of your contract term or the exercise of a Buyout Option, as defined in your signed agreement.

6. Payments and Cancellation

• Billing: All billing terms, including monthly subscription fees, late fees, and automatic payments, are governed by your signed Service Agreement.
• Termination: Cancellation policies, including early termination fees and minimum commitment terms, are strictly detailed in Section 5 and Section 6 of your Service Agreement.

7. Limitation of Liability

To the fullest extent permitted by law, Area Code Technologies LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or services, including service interruptions or third-party hosting failures.
